Evidence Preparation in Construction Arbitration

Thank you to the ICE HKA G&S and Chartered Institute of Arbitrators (CIArb) for inviting me to speak at the seminar on evidence in arbitration. I discussed breakfast choices, the shooting of Bambi’s mother, 911 and OJ Simpson to show that memory is fallible, explored the types of records that should be kept by project teams and explored the difficulties in keeping site records. My fellow presenters Richard Poon, James Johnson and Warren Suen looked at the legal aspects of evidence, expert evidence and some recent case law regarding expert evidence. I hope the attendees took away some new insights into the importance of evidence throughout the project cycle.
