With Hong Kong being impacted by an outbreak of the highly transmissible Omicron variant, many construction projects are facing the prospect of suspensions to limit the spread of the virus. In early 2020, we reviewed the various Hong Kong and international contract forms to identify the contractual routes for COVID delays. Our second article in April 2020 paper covered the Hong Kong Institute of Architects, NEC and FIDIC Red Book forms. As always, the terms of the specific contract need to be reviewed as amendments may vary the route to recovery.
