With Hong Kong being impacted by an outbreak of the highly transmissible Omicron variant, many construction projects are facing the prospect of suspensions to limit the spread of the virus. In early 2020, we reviewed the various Hong Kong contract forms to identify the contractual routes for COVID delays. Our March 2020 paper covered the Government General Conditions, Airport Authority and MTR. Whilst direct routes for pandemic claims are not generally available, there are indirect routes which may offer some relief.
